1. Acceptance of terms
These Terms of Service (“Terms”) govern your use of mx-family-tree (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not create an account and do not use the Service.
2. Description of the service
mx-family-tree is a web application that allows you to record, organize, visualize, and share genealogical information about your family. You can create a family tree, add people and relationships, upload photos and documents, and invite trusted collaborators to view or edit your tree.
3. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these eligibility requirements.
4. Your account
You are responsible for the security of your account, including keeping your password confidential and notifying us promptly of any unauthorized access. You are responsible for all activity that occurs under your account.
5. Your content
You retain ownership of the information and files you add to the Service (your “Content”). By adding Content to the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, display, and process your Content solely for the purpose of providing the Service to you and your authorized collaborators.
We do not claim any ownership over your family data. You can export your Content at any time (for example, as a GEDCOM file) and you can delete your Content and your account at any time.
6. Acceptable use
You agree not to use the Service to:
- Violate any law or regulation
- Infringe on the intellectual property or privacy rights of others
- Upload or share Content that is defamatory, harassing, obscene, or otherwise objectionable
- Upload malware, attempt to probe, scan, or test the vulnerability of the Service, or interfere with its normal operation
- Use the Service to harvest or collect information about other users without their consent
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or any related systems
We reserve the right to remove Content that violates these Terms and to suspend or terminate accounts that repeatedly violate them.
7. Privacy and shared trees
When you invite a collaborator to a shared tree, they will be able to view (and, depending on the role you assign, edit) the people, relationships, photos, documents, and audit history associated with that tree. Be thoughtful about what you share and with whom.
Family data often contains sensitive information about people who are not your account holders — your relatives, ancestors, and descendants. You are responsible for ensuring that your use of the Service complies with any applicable laws and with any wishes those individuals have expressed about their data.
8. Paid features
If and when paid features are introduced, the specific terms of any paid plan (pricing, billing, cancellation, refund policy) will be disclosed to you before you purchase. Paid plans are optional and the Service will continue to offer a free tier.
9. Service availability
We strive to keep the Service available and working, but we do not guarantee uninterrupted or error-free operation. We may need to suspend the Service occasionally for maintenance, updates, or security reasons. We will do our best to give you notice before planned downtime.
10. Termination
You can delete your account at any time from your account settings. We may suspend or terminate your account if we believe you have violated these Terms, if required by law, or if continuing to provide the Service to you creates legal or operational risk.
When your account is deleted, your Content will be deleted as described in the Privacy Policy.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Family tree data is inherently subject to interpretation and uncertainty. We do not verify the accuracy of the information you or your collaborators enter, and we make no representations about the historical accuracy of any Content stored in the Service.
12. Limitation of liability
To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service.
Our total liability to you for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim or (b) 50 US dollars.
13. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your Content, or your violation of these Terms.
14. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you by email and update the “last updated” date at the top of this page. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
15. Governing law
The governing law and exclusive jurisdiction for any disputes arising out of these Terms will be set prior to the public launch of the Service. Pending that determination, these Terms will be interpreted in a way that reflects the intent of the parties and standard SaaS practice.
